A. Introduction

At Augvu, LLC (“Company” or “We“) we believe your memories deserve the highest level of care and protection. We are committed to safeguarding your personal information and ensuring transparency about how we handle it.

This Privacy Policy (“Policy”) explains:

  • What information we collect when you use Augvu’s Mobile Application (the “App”).
  • How we collect, use, store, and protect that information.
  • Your rights and choices regarding your data.

This Policy applies to information collected through the App and related electronic communications (e.g., emails, text messages). However, it does not apply to:

  1. Information collected offline or through other Augvu websites or apps, even if linked through the App.
  2. Information collected by third parties, such as external services, advertisements, or linked content.

We encourage you to review third-party privacy policies before sharing your information with them.

By downloading, registering for, or using the App, you agree to the terms of this Policy. If you do not agree, we kindly ask you to refrain from using the App.

As we grow and improve Augvu, we may update this Privacy Policy to reflect changes in our practices or legal requirements. Updates will be reflected in the “Last Updated” date at the top of this page.

B. Children Under the Age of 13

The App is not designed or intended for children under 13 years of age, and we do not knowingly collect personal information from children under 13. If we become aware that we have inadvertently collected personal information from a child under 13 without verified parental consent, we will take immediate steps to delete such information.

C. Information We Collect about you and How We Collect It

We collect information from and about users of our App in two primary ways:

  1. Directly From You
    This includes information you provide voluntarily, such as:
    • When you register for an account or interact with the App.
    • When you upload content (e.g., photos, videos, or location-based Augvus).
      • As Augvu evolves, we may explore additional ways to collect geolocation-based content to enhance your experience with location-tagged Augvus.
    • When you communicate with us, such as through customer support requests or feedback.
  2. Automatically
    When you register, access, or use the App, certain information is collected automatically through technology, including:
    • Usage Details: Information about how you interact with the App, such as features accessed, time spent, and user activity logs.
    • Device Information: Data about your mobile device, such as the unique device identifier (UDID), IP address, operating system, browser type, mobile network information, and device settings.
    • Cookies and Tracking Technologies: Information collected through cookies, web beacons, and similar technologies to analyze usage trends and enhance your experience.

D. Information You Provide to Us  

When you download, register with, or use this App, we may ask you to provide certain types of information, including:

  1. Personal Information
    Information by which you can be personally identified, such as:
    • Name, postal address, email address, telephone number, and date of birth.
    • Any other information that is classified as personal or personally identifiable under applicable laws (“personal information”).
  2. Non-Personal Information
    Information that relates to you but does not individually identify you, such as:
    • Username, password, credit or debit card details, and other payment information.
    • Usage data, device information, cookies, and other tracking technologies.
    • Content information (e.g., photos or videos you upload), device phonebook, and location data.
    • Information obtained from third parties.
Examples of Information You May Provide

This includes, but is not limited to:

  • Forms and Registrations: Information you provide when registering, subscribing to services, posting content, or requesting assistance.
  • Correspondence: Records and copies of communications, such as customer service inquiries.
  • Surveys and Feedback: Responses to surveys or research requests.
  • Transactions: Details of purchases, including financial information if required for payment processing.
  • Search Queries: Data related to searches or activities within the App.
User Contributions and Public Sharing

You may also provide information for publication or display in public areas of the App or other platforms accessible through the App (collectively, “User Contributions”).

  • Responsibility for Sharing: User Contributions are shared at your own risk. While you may have the option to set privacy preferences, no system is entirely secure or impenetrable.
  • Third-Party Access: We cannot control how third parties who access public areas of the App use your information. Therefore, we cannot guarantee the privacy or security of your User Contributions once shared.

E. Automatic Information Collection and Tracking  

At Augvu, we prioritize preserving your memories while safeguarding your privacy. To provide our services and enhance your experience, the App may automatically collect the following types of information when you download, access, or use it:

  1. Usage Details
    Information about how you interact with the App, including traffic data, logs, communication details, and resources accessed.
  2. Device Information
    Details about your mobile device and internet connection, such as unique device identifiers (UDID), IP address, operating system, browser type, mobile network information, and device phone number.
  3. Stored Information and Files
    Metadata and other information associated with files stored on your device, such as photos, videos, personal contacts, and address book data.
  4. Location Information
    Real-time device location data is collected to enable location-based features of the App. Please note that opting out of location data collection through your device settings may limit certain functionalities.

  5. Your memories matter to us, which is why we retain your data for as long as necessary to provide our services and meet legal or operational requirements. As long as your account is active, your Augvus—including photos, videos, and location data—will remain securely stored, allowing you to revisit and cherish them anytime.
  6. Deletion by Users
    You can delete individual Augvus or your account at any time. Deleted content will be removed from your account and primary systems within 90 days. However, encrypted backups or logs may temporarily retain copies for recovery or compliance purposes.
  7. Backup and Recovery
    We maintain encrypted backups to protect your memories from accidental deletion, technical errors, or unexpected events. These backups are strictly used for recovery purposes.
  8. Legal Compliance and Safety
    In some cases, we may retain data longer to comply with legal obligations, resolve disputes, or enforce agreements.
  9. De-Identified Data for Research and Improvement
    After you delete your account, we may retain de-identified or aggregated data to improve our services, conduct analytics, and perform research. This data is never linked back to your account.
  10. Lifelong Accessibility
    Your memories are designed to last a lifetime. By maintaining an active account, you ensure continued access to your Augvus. If you prefer not to share specific data, you can adjust your settings or delete the App from your device. Disabling certain data collection—such as location tracking—may limit the functionality of location-based features.

Behavioral Tracking and Do Not Track (DNT) Signals
We may use technologies to collect information about your activities within the App over time. These tools help us understand user preferences and improve your experience. However, Augvu’s MVP does not currently support in-app settings for managing or opting out of behavioral tracking.

If you prefer to limit tracking, you can adjust your device or browser settings to control certain data collection practices. Here’s how:

  • Mobile Device Settings:
    • iOS: Navigate to Settings > Privacy > Tracking to manage app tracking permissions.
    • Android: Go to Settings > Privacy > Ads, and select “Opt out of Ads Personalization.”
  • Browser-Level Controls:
    • Many browsers allow you to block or limit cookies and tracking technologies through their settings. You can also enable “Do Not Track” (DNT) signals, but Augvu does not currently respond to DNT signals.

Please note that disabling tracking via your device or browser settings may affect certain functionalities of the App, such as personalized features or recommendations. F. Information Collection and Tracking Technologies 

To enhance your experience and improve our services, we use a variety of technologies to automatically collect information when you access or use the App. These technologies include:

  1. Cookies (or Mobile Cookies)
    • Cookies are small files placed on your smartphone or device that allow us to recognize your preferences, improve functionality, and enhance your experience with the App.
    • You can refuse to accept cookies by adjusting the settings on your device. However, disabling cookies may limit your ability to access certain features or functionalities of the App.
    • If we integrate analytics or advertising tools such as Google Analytics or similar services, we will update this section to disclose their use and functionality.
  2. Web Beacons
    • Our App and emails may include small electronic files known as web beacons (also referred to as clear gifs, pixel tags, or single-pixel gifs). These are used to:
      • Count users who visit specific pages or open our emails.
      • Track the popularity of certain content.
      • Verify the integrity of our systems and servers.
  3. Other Technologies
    • We may also use:
      • Web Storage: To store information on your browser or device for faster load times and improved performance.
      • Unique Advertising Identifiers: To gather data about your device or activity for analytics, troubleshooting, and marketing purposes.

G. Third-Party Information Collection

When you use the App or its content, certain third parties may use automatic information collection technologies to gather data about you or your device. These third parties may include:

  1. Advertisers, Ad Networks, and Ad Servers
    • These entities may collect data to deliver interest-based advertising or targeted content.
  2. Analytics Providers
    • Companies that help us understand how users interact with the App by collecting data on usage patterns and behaviors.
  3. Device Manufacturers and Service Providers
    • Your mobile device manufacturer or service provider may collect information as part of their operations.
How Third Parties May Use Your Information

These third parties may use cookies, web beacons, and other tracking technologies to:

  • Collect information about your activities within the App and across other websites, apps, or online services.
  • Associate this data with your personal information to deliver personalized advertising, content, or services.
Limitations of Control

We do not control these third parties’ tracking technologies or how they use the information they collect. If you have questions about targeted advertising or other practices by these third parties, we recommend contacting them directly.

H. How We Use Your Information

    • Ensure functionality, performance, and a personalized user experience.
    • Deliver the App and its contents, along with any requested information, products, or services.
  2. Communicate with You
    • Notify you about your account, subscriptions, or transactions, including expiration and renewal notices.
    • Provide updates about App changes, new features, or product improvements.
  3. Fulfill Obligations and Enforce Rights
    • Carry out contractual obligations, including billing, collection, and legal enforcement.
  4. Improve Your Experience
    The usage information we collect helps us to:
    • Understand audience size, usage patterns, and preferences.
    • Customize the App to align with your individual interests and speed up searches.
    • Recognize you when you return to the App, creating a seamless experience.
  5. Contextualize Your Memories
    • Use location information to enhance your experience by accurately tagging memories (Augvus) and delivering location-specific features, provided you have granted permission for location data collection.
  6. Marketing and Advertising
    • Contact you about our own or third parties’ goods and services that may interest you.
      • If you do not wish to receive such communications, you can update your preferences in your account settings or during registration.
      • Refer to Section J: Your Choices About Our Collection, Use, and Disclosure of Your Information for more information.
    • Use aggregated or anonymized data to display advertisements to target audiences without sharing personal information directly.
  7. With Your Consent
    • For any other purpose explicitly agreed upon by you.

I. Disclosure of Your Information

We may disclose aggregated information about our users, as well as information that does not identify any individual or device, without restriction.

In addition, we may disclose personal information that we collect or that you provide to us in the following circumstances:

  1. Within Augvu and Its Affiliates: We may share your information with our subsidiaries and affiliates for operational and business purposes.
  2. With Service Providers and Business Partners:
    • Contractors and Service Providers: Information may be shared with contractors, service providers, and third parties who support our business operations. These parties are bound by contractual obligations to keep your personal information confidential and to use it only for the purposes we disclose.
    • Third-Party Marketing: With your consent or unless you opt out, we may share your information with third parties to market their products or services to you. These parties are also contractually required to safeguard your information. For more details, see Section J: Your Choices About Our Collection, Use, and Disclosure of Your Information.
  3. During Business Transactions: In the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of Augvu, LLC’s assets, your personal information may be included as part of the transferred assets.
  4. To Fulfill Specific Requests: For example, if you use the “email a friend” feature of the App, we will share your email address and the contents of the email with the recipient.
  5. Legal and Contractual Obligations:
    • Compliance with Laws: We may disclose your information to comply with court orders, laws, or regulatory requirements.
    • Contract Enforcement: Your information may be disclosed to enforce our rights under any contracts you’ve entered with us, including the App EULA, Terms of Service, and billing agreements.
  6. Safety and Fraud Prevention: We may disclose information if necessary to protect the rights, property, or safety of Augvu, LLC, our users, or others. This includes sharing information with other organizations to prevent fraud or reduce credit risk.
  7. With Your Consent: We may disclose your personal information for any purpose with your explicit consent.

J. Your Choices About Our Collection, Use, and Disclosure of Your    Information

We strive to provide you with clear options for managing your personal information. Below are mechanisms available to control how your data is collected, used, and shared:

1. Tracking Technologies: You can adjust your device or browser settings to manage tracking preferences.

  • Mobile Device Settings: For iOS, navigate to Settings > Privacy > Tracking to manage app tracking permissions. For Android, go to Settings > Privacy > Ads, and select “Opt out of Ads Personalization.”
  • Browser Controls: Adjust cookie settings in your browser or enable “Do Not Track” (DNT) signals. Please note that Augvu does not currently respond to DNT signals but provides other methods for managing tracking as described in this Policy. For further details, refer to Behavioral Tracking and Do Not Track (DNT) Signals in this Policy.

2. Location Information: You can control whether the App collects real-time location data by adjusting location settings in your device’s privacy settings. Note: Disabling location data may limit location-based features of the App, such as accessing geofenced Augvus.

3. Promotion by Augvu: If you prefer not to receive promotional emails or messages, you can opt out by clicking the “Unsubscribe” link in our emails or contacting us at justin@augvu.com.

4. Targeted Advertising by Augvu: To manage preferences for targeted advertising, use your device settings as described under Tracking Technologies. Note: You may still see advertising, but it will not be personalized based on your behavior.

5. Disclosure of Your Information for Third-Party Advertising and Marketing: If you prefer not to have your personal information shared with unaffiliated third parties for advertising or marketing purposes, contact us at justin@augvu.com to request exclusion.

K. Accessing and Correcting Your Personal Information

You can request access to, correction of, or deletion of the personal information you have provided to us by contacting us at justin@augvu.com.

Please note:

  • We cannot delete your personal information without also deleting your user account.
  • We may not accommodate requests to change information if we believe the change would violate any law, legal requirement, or result in incorrect information.

If you delete your User Contributions from the App, copies of your contributions may still be visible in cached or archived pages, or may have been copied or stored by other users of the App. Proper access and use of information, including User Contributions, is governed by our [Terms of Use].

California Residents
California residents have specific rights regarding their personal information under the California Consumer Privacy Act (CCPA). These rights include:

  • Right to Know: Learn what categories of personal information we collect and how we use or share it.
  • Right to Delete: Request the deletion of your personal information, subject to certain exceptions.
  • Right to Opt-Out: Opt out of the sale of your personal information.
  • Right to Non-Discrimination: Exercise your rights without discrimination.

L. Data Security

We take your privacy and the protection of your personal information seriously. To safeguard your data, we have implemented measures designed to protect it from accidental loss, unauthorized access, misuse, alteration, and disclosure. Information you provide to us is stored on secure servers protected by firewalls, and any payment transactions are encrypted using SSL technology.

Your Responsibility: The security of your personal information also depends on you. If we provide you with a password (or if you choose one) to access certain parts of the App, you are responsible for keeping this password confidential. We ask that you do not share your password with anyone and exercise caution when sharing information in public areas of the App, such as forums or message boards. Information shared in these areas can be viewed by other users.

Limitations of Security: While we strive to protect your personal information, the transmission of data over the internet or mobile networks is not completely secure. Although we employ safeguards, we cannot guarantee the security of your personal information during transmission to or from our App. Any transmission of personal information is at your own risk.
