Augvu Terms of Use

A. Introduction
Welcome to Augvu. These Terms of Use (“Terms”) govern your access to and use of Augvu’s mobile application (“App”) and related services. By using Augvu, you agree to these Terms. If you do not agree, do not access or use Augvu or any services covered by these Terms.
These Terms constitute an agreement between you and Augvu, LLC, and incorporate our Privacy Policy by reference. They supersede any prior agreements between you and Augvu related to your use of our services. By creating an account, checking the agreement box during sign-up, or using the App, you affirm that you have read, understood, and agree to these Terms, including the binding arbitration clause and class action waiver in Section O.
If you do not agree, do not download, install, or use the App.
B. Our Services
Augvu provides a digital platform that enables users to:
- Upload, share, and discover location-based memories (“Augvus”).
- Connect with other users through shared content.
- Use geolocation features to enhance discovery and engagement.
- Access new functionalities that we may develop to support memory preservation and community building.
We may modify or expand these services at any time, and these Terms will apply to all features unless stated otherwise.
C. Your Responsibilities
You are responsible for the following when using Augvu:
- Be at least 13 years old (or the required legal age in your jurisdiction). Not use the App if you are under 13 years old. Augvu does not knowingly collect or store personal data from users under the age of 13. If we discover such an account, we will delete it immediately.
- Not use Augvu if you are prohibited from receiving our services under applicable laws.
- Provide accurate and truthful account information.
- Maintain the security of your login credentials and not share them with others.
- Use the App only for lawful purposes and in compliance with these Terms.
D. Changes to These Terms
We may modify these Terms periodically. Updates will be posted with a revised “Last Updated” date. Your continued use of Augvu constitutes acceptance of the new Terms. If changes are significant, we may notify you via email, in-app alerts, or other appropriate channels.
E. User Accounts & Security
- You are responsible for all activities under your account.
- We may suspend, disable, or terminate accounts that violate these Terms.
- If you suspect unauthorized access, notify us immediately at justin@augvu.com.
- We may disable accounts that remain inactive for extended periods.
F. User-Generated Content
Augvu allows you to upload, share, and publicly post content (“User Content”).
- You retain ownership of your content but grant Augvu a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to host, use, distribute, modify, and display your content within the App.
- You must have the rights to any content you upload.
- You are responsible for ensuring your content complies with applicable laws and these Terms.
- Augvu may remove content that violates these Terms or applicable law.
- Content Moderation and Reporting
- Users may report content they believe violates these Terms by using in-app reporting tools (if available) or contacting Augvu support directly. While Augvu may review flagged content, we make no guarantees regarding the timing or outcome of such reviews.
- You acknowledge that:
- Augvu is not liable for any delay or failure to act upon a report.
- Augvu may, at its sole discretion, remove or restrict access to content—even if it does not clearly violate these Terms—if deemed harmful, inappropriate, or disruptive to the community or platform.
- Moderation actions are final and are not subject to appeal unless required by applicable law.
- Upon account deletion, your public Augvus may remain accessible to other users unless you request their removal in writing. Augvu may retain backup or archival copies of your content as required by law, to comply with legal obligations, resolve disputes, enforce our agreements, or for other legitimate business needs.
- Augvu may, at its sole discretion, remove or restrict access to any content, whether or not it violates these Terms, if it believes such action is in the best interest of the community or platform integrity.
- Augvu reserves the right to remove or restrict access to users, accounts, or specific Augvus at any time, with or without notice. Users may also be blocked by other users at their discretion.
We do not guarantee that appeals of moderation or account actions will be reviewed or reversed.
Prohibited Content
You may not upload, share, or post content that:
- Is illegal, defamatory, harassing, or threatening.
- Promotes violence, hate speech, or discrimination.
- Contains nudity, sexually explicit material, or illegal activities.
- Infringes on copyrights, trademarks, or other intellectual property rights.
- Violates any law, regulation, or these Terms.
G. Third-Party Services
Augvu integrates third-party services to enhance functionality. By using the App, you acknowledge that third-party services operate under their own terms and policies, and Augvu is not responsible for their practices.
H. Privacy & Data Use
Your use of Augvu is also governed by our Privacy Policy, which explains how we collect, use, and store your data. Augvu may use aggregated, anonymized data—including metadata from user-generated content such as location, timestamps, and content interactions—to improve its products, develop new features, train machine learning algorithms, or support internal research and analytics, all in accordance with our Privacy Policy.
I. Prohibited Conduct
You agree not to:
- Violate any applicable laws or regulations.
- Impersonate others or create fraudulent accounts.
- Attempt unauthorized access to Augvu’s systems.
- Use automated tools (bots, scrapers) to collect data.
- Disrupt, interfere with, or overburden Augvu’s servers.
- Misuse reporting, flagging, or appeals processes.
- Enter or encourage others to enter restricted, dangerous, or private areas to access Augvus.
- Use the App in any way that endangers yourself or others, including while operating a vehicle or in hazardous environments.
- Use the App in violation of local laws regarding location-based activity, trespassing, or data collection.
J. Intellectual Property
- Augvu retains all rights to its name, branding, trademarks, and proprietary content.
- You may not copy, distribute, or modify Augvu content without written permission.
- Unauthorized use of Augvu’s intellectual property may result in legal action.
K. Advertising & Monetization
- Augvu may introduce advertising and sponsored content in the future.
- Ads may be personalized based on user data, in accordance with our Privacy Policy.
- Users may have the ability to manage ad preferences through future settings.
- Users who promote products, services, or brands in Augvus must comply with applicable advertising laws and clearly disclose sponsored content. Augvu reserves the right to remove or flag undisclosed paid promotions.
L. Disclaimers & Limitation of Liability
- The App is provided “as is,” without warranties of any kind.
- Augvu does not guarantee uninterrupted service, security, or error-free functionality.
- To the fullest extent permitted by law, Augvu is not liable for indirect, incidental, special, consequential, or punitive damages related to your use of the App.
- Augvu is not responsible for the accuracy, safety, legality, or appropriateness of any user-uploaded content. All content is the sole responsibility of the person who created or uploaded it.
- Augvu is not responsible for the loss, deletion, corruption, or failure to store any content, including Augvus, trip data, or user-uploaded memories.
M. Real-World Risk Disclaimer and Assumption of Responsibility
Real-World Interactions and Safety
Augvu enables users to access and create geolocation-based content that may require physical travel or exploration of real-world environments. By using the App, you acknowledge and agree that:
- You are solely responsible for your physical safety, awareness of your surroundings, and compliance with all applicable laws while accessing or attempting to access geofenced content (“Augvus”).
- Augvu does not monitor, verify, or guarantee the safety, accessibility, legality, or condition of any location where Augvus are placed or accessed.
- You agree to exercise reasonable and prudent judgment when using the App, including refraining from viewing Augvus while driving or entering private or restricted property.
- The App is not intended to be used for navigation, emergency response, or safety planning. You agree not to rely on the App for any time-sensitive or life-critical decisions.
Assumption of Risk
You voluntarily assume all risks associated with your use of Augvu in real-world locations, including but not limited to accidents, injuries, property damage, or legal consequences arising from your actions.
Indemnification
You agree to indemnify, defend, and hold harmless Augvu, LLC, its officers, directors, employees, contractors, partners, and affiliates from any claims, losses, damages, liabilities, and expenses (including attorneys’ fees) arising from your use of the App in the physical world, including but not limited to injury, trespassing, or property damage.
N. Account Suspension & Termination
We reserve the right to suspend, limit, or terminate your access to Augvu if:
- You violate these Terms or applicable laws.
- You engage in behavior that harms Augvu or other users.
- Your account remains inactive for an extended period.
- We discontinue or modify any part of our services.
O. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Arizona, United States, where Augvu, LLC is legally registered. However, given that Augvu is actively developed and operated from Washington, D.C., and Virginia, certain federal and state laws applicable to those jurisdictions may also apply.
Any disputes, claims, or controversies arising out of or relating to these Terms shall be resolved exclusively by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. The arbitration shall be conducted in Maricopa County, Arizona, unless otherwise required by applicable law.
Notwithstanding the foregoing, Augvu retains the right to seek injunctive relief or other equitable remedies in any court of competent jurisdiction to enforce its intellectual property rights or to prevent unauthorized use of its services.
By using Augvu, you waive your right to participate in any class action lawsuit or class-wide arbitration against Augvu. However, given that Augvu is actively developed and operated from Washington, D.C. and Virginia, applicable federal and state laws may apply depending on jurisdictional considerations. Any disputes shall be resolved through binding arbitration in Maricopa County, Arizona, except where prohibited by law. Users waive their right to participate in class action lawsuits against Augvu.
P. Miscellaneous
- Severability: If any provision of these Terms is deemed unenforceable, the remaining terms shall remain in effect.
- No Waiver: Failure to enforce any provision of these Terms does not constitute a waiver.
- Assignment: You may not transfer or assign your rights under these Terms without Augvu’s written consent.
- Force Majeure
Augvu shall not be held liable for any failure or delay in performance due to causes beyond its reasonable control, including but not limited to natural disasters, internet outages, war, labor disputes, government actions, or any other unforeseen circumstances that prevent Augvu from fulfilling its obligations under these Terms.
